Why is it important to have a Will?

What happens if I pass away without a valid Will?

A deceased person without an acceptable Will are classed as ‘intestate.’ If this is the case then your estate will be divided up as per the laws of intestacy. There are firm rules that are governed by intestacy laws which will not take your personal wishes into account. As well as your estate not being divided according to your wishes there will likely be added financial costs and stress for your beneficiaries.

What is a Power of Attorney?

A power of attorney is a person who is legally directed to act for you in respect of your financial and legal affairs. Having an enduring power of attorney in place is equally as important as having a legally binding Will.

What is Probate?

A Grant of Probate is an order granted by the Supreme Court of Queensland and examines the authority of the Executor to manage the deceased Estate. It acts as security and offers protection to banking institutions and other companies who hold money on behalf of the deceased person by confirming that the Will is valid and the Executor was legally appointed.

What are Letters of Administration?

If a person dies without a valid Will, or the Will doesn’t include an appropriate Executor named, the person who will be going to look after the deceased Estate will need to get a Grant of Letters of Administration from the Supreme Court of Queensland. This will person will be come the “Administrator” of the deceased Estate.
