Turner Freeman Partner and defamation specialist Terry Goldberg writes about the James Phillips v CC Medical Offices Pty Ltd and Brad Robinson defamation case

In his case James Phillips, an osteopath sued CC Medical Offices Pty Ltd and Brad Robinson after they published defamatory statements on their website of and concerning him, and which he also alleged breached The Australian Consumer Law.

The defamatory statements were on the website for five days from 5 March 2011 to 10 March 2011 when an application for an urgent injunction resulted in the defamatory material being removed.

When the case eventually went for final hearing, James Phillips was awarded damages of $50,000 together with an injunction permanently restraining the defendants from publishing the material or like material.
